Please read these terms and conditions of use carefully. When you agree to purchase from OCTASMART® you enter into a contract with us, and you accept that you will be bound by the terms and conditions contained in this notice.

This sale agreement is a legally binding contract between you and OCTASMART®

OCTASMART® reserves the right to change the terms and conditions on this site without notice to you. You will be bound by the terms and conditions operating at the time you place your order with us.
All prices include GST.

Title to the goods purchased by you remains with us until you have paid for them. Once the goods are paid for in full, the title will pass to you.
Where goods are not purchased for your personal or household or domestic use, OCTASMART® expressly excludes all conditions and warranties, expressed or implied, as to merchantability, fitness for purpose.

Orders made by you for products on our website or over the phone are not binding on or with OCTASMART® until accepted by us.

You are unable to change or cancel your order after we have accepted it.
Access to the OCTASMART® website shall be provided by your internet service provider. OCTASMART® will not be liable for failure of service by your internet service provider.

OCTASMART® will make all reasonable efforts to ensure that information on the website is accurate and correct but makes no representations as to the accuracy of the information. OCTASMART® assumes no liability for any errors or omissions contained on the website.

OCTASMART® will send you the goods you ordered within 28 business days of receipt of your payment.

OCTASMART® delivers to most of Australia and New Zealand with the exception of postcodes where delivery restrictions apply, this includes, but is not exclusive to; 0880, 0881, 0885, 0906, 0907, 0909, 2898, 2899, 3921, 9999, 4801, 4803, 4875, 9464, 9600, 5713, 5715, 5717, 5732, 5733, 5734, 6798, 6799, 7255, 7256, 7257.

OCTASMART® offers a thirty-day return policy on all products.

OCTASMART® may offer more than a thirty-day return policy on selected products at its discretion and subject to change without notice.

Our OCTASMART® products have a 30 day returns policy, unless stated otherwise on product page. Under the returns policy OCTASMART® will reimburse you the cost of your product if returned because you have changed your mind or for a reason other than fault or failure. To be eligible for a refund the product or offer must be returned in full with all accessories and any bonus gifts included. OCTASMART® will not refund the postage and handling on a product returned under this clause. 

You must enclose the following details with the returned product:
1. Your full name
2. A copy of your invoice or order number
3. Reason for return
4. Your contact telephone number
OCTASMART® will not be responsible for items that are lost or misdirected. You are strongly advised to send your returned product by registered post.

You may not return goods to OCTASMART® after the thirty-day return period has expired unless you are exercising your rights under statutory conditions and warranties that cannot be excluded.

OCTASMART® may advertise payment plans where you pay the purchase price of the goods you have ordered by monthly instalment. If you pay by credit card you agree that OCTASMART® may debit your card each instalment until payment in full.

If OCTASMART® attempts to debit your card and you have insufficient funds to pay the instalment, we may at our discretion ask you to do one or more of the following things:

  1. pay the missed instalment;
    2. pay any charges or fees charged to OCTASMART® for the failed attempt to debit the instalment amount.
  2. pay the balance owing on your account immediately.

    OCTASMART® may report you to a credit reporting agency if you default in payment of the goods.

OCTASMART® may charge you interest calculated daily at the rate of 9% per annum on the balance outstanding on your account from the date payment was due until payment in full if you default in payment of your account.

If you default in any payments due to OCTASMART® you agree to pay us on demand all costs, expenses and liabilities incurred by us in connection with or in the actual or attempted exercise or enforcement of this sale agreement.

This sale agreement shall be governed by the law of the State of New South Wales.
This sale agreement contains all the terms and conditions contained in our contract with you, and cannot be modified without the written consent of either party.
If you disagree with any of the terms contained in this sale agreement, then please do not shop at this website.

OCTASMART® shall not be responsible for any loss of damages, however occurring, resulting as a consequence of your use of this website. Limitation of liability is extended but not limited to negligence, special, consequential, direct or indirect damages, including but not limited to loss of data, profit or any other loss however caused resulting from your use of this website.

You agree to be bound by the laws of the State of New South Wales.
You agree that you are over 18 years of age, and that if you are under the age of 18 years that you are supervised by your parent or guardian whenever you use this website. If you are under 18 years, OCTASMART® reserves the right to refuse you service, to terminate your account, or to cancel your contract.

OCTASMART® will not be held responsible where your account or computer terminal is used without your consent. It is your responsibility to maintain the confidentiality of your account and access to your computer terminal. It is your duty to keep your credit card in a secure location, and not to divulge your details so as to permit unauthorised use.

Any images or videos or content submitted to OCTASMART® via product reviews, social media or email, but not limited to these platforms, may be publicly displayed, used or repurposed at the discretion of OCTASMART® on any platform or format. If you do not agree to these terms, please contact our customer service team at enquiries@octasmart.com.au.

Mobile Terms of Service

The OCTASMART® mobile message service (the "Service") is operated by OCTASMART® (“OCTASMART®”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to OCTASMART® SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of OCTASMART® through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialling system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with OCTASMART®. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to OCTASMART® or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other OCTASMART® mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
